May 4th 2010 7:44PM @Nilay Patel Why isn't h.264 vulnerable to submarine patents like Ogg Theora is? And in the event of a submarine patent, who's liable? Xiph/MPEG-LA, people using the encoder, or people using the decoder?

The Alcatel-Lucent MP3 patent suit a couple years ago is evidence that MPEG-LA holding lots of the h.264 patents doesn't mean they hold all of them. Isn't it a red herring to say Ogg Theora is vulnerable to submarine patents while h.264 is safe from that concern?
