May 13th 2011 9:55AM Yes Windows IS generic, but officially it is called MICROSOFT Windows. Microsoft can use the simpler Windows because at this point there is no point of confusion from a trade perspective. Ask anyone about windows in a computing sense and they know exactly what you mean. This was the point of trademarks.

What Microsoft wants is for it to be called Apple App Store as a distinction BEFORE it sets in with people that App Store is an Apple thing. Its a smart legal move to prevent it from becoming baked into the public psyche and hence a specific reference to Apple's store.

However what Microsoft is doing that isn't correct is trying to use the term 'App' as the distinction point. Yes many people have heard of the term app or referred to applications as apps - but it isn't until recently that there has been an 'App Store' which is a distinction in itself. People with Google phones don't refer to their stores as an 'app' store, they refer to it as the marketplace - etc. Microsoft will have to prove that some confusion rises in the mind of the consumer such that a reference to app store will have them buying the wrong product. We need to be careful in this discussion what the trademark is actually there to prevent - its not there to just speak to whether or not words or generic or in common use.

Mar 25th 2011 2:39PM Its not a waste of tax dollars and given that the US military is an extreme user of petro this is smart for the military to be doing ESPECIALLY now when prices are going up and projected to continue to go up in the future. We won't stop flying aircraft just because fuel prices increase, we'll just be paying more for it.

We can argue the value of sustained operations and so forth, but this definitely isn't a waste of funds.

You do realize that the author is talking about a long string of posts. I think Erica is great and respect the intellectual investigation, but most times there is an investigation of the Apple platform from the perspective of "it should be open, let's open it - to hell with everything else" and while this is cool - it does indeed over time have an "anti-Apple" tinge.
